Updated VIBEcoder Subscription Terms and Conditions

Welcome to VIBEcoder's Alpha Phase

Thank you for considering joining us on this exciting journey with VIBEcoder! Before we dive into the formal terms, I want to take a moment to personally thank you on behalf of our founder, Greg Spehar. By signing up during this Alpha Phase, you're not just a subscriber—you're a supporter helping to bring Greg's vision for VIBEcoder to life. Your contribution means the world to us, and we're so grateful for your trust and encouragement as we work to make VIBEcoder a reality.

1. Nature of This Agreement (Alpha Phase Support)

By signing up for a VIBEcoder subscription during this Alpha Phase, you acknowledge that you are providing a gift of support to Greg Spehar to his for profit company GiDanc AI LLC, the founder of VIBEcoder, to help fund his full-time efforts to develop VIBEcoder into a fully functional product. At this stage, no services, features, or products are being provided. This means that the subscription plans (Basic, Sync, Cleanup, Elite) outlined on our subscription page are placeholders for future offerings and do not currently grant access to any tools, features, or support channels.

Your contribution is a non-refundable donation to support the development of VIBEcoder, and we deeply appreciate your generosity in helping us turn this dream into reality.

2. Subscription Plans and Pricing

Our subscription page currently lists the following plans as a preview of what's to come:

• VIBEcoder Basic: $5/month (future offering: Basic Process Toolkit, Documentation Specialist Insights, Community Support)
• VIBEcoder Sync: $15/month (future offering: All Basic Features, Access to Sync Tool, Access to Enhanced Rules Group)
• VIBEcoder Cleanup: $45/month (future offering: All Sync Features, Access to Cleanup Toolkit, Enhanced Metrics, Dedicated Email Support)
• VIBEcoder Elite: $100/month (future offering: All Cleanup Features, Advanced AI Integrations (Future), Dedicated Elite Support Channel, Access to Elite Rules Group, 60-min Dedicated Time)

Important Note: These plans and their associated features are not yet available. Your payment during this Alpha Phase is a gesture of support and does not entitle you to any services, features, or benefits at this time. We will notify you via the email associated with your account when VIBEcoder officially launches and these features become available.

All fees are exclusive of applicable taxes. You are responsible for any taxes that may apply to your contribution, which will be charged in addition to the amount you choose to donate.

3. Billing and Renewal

Your support contribution will be billed on a monthly basis, based on the plan you select. Your contribution will automatically renew each month until you choose to cancel. By signing up, you authorize us to charge your payment method on a recurring basis for the selected plan amount, plus any applicable taxes.

If we are unable to charge your payment method, we may reach out to you to update your payment information. Since this is a support contribution, there will be no suspension or termination of services (as none are currently provided).

4. Cancellation

You may cancel your recurring contribution at any time through your account settings or by contacting us at greg@gidanc.ai. Upon cancellation, your support will cease at the end of the current billing period, and no further charges will be made.

As this is a gift of support during the Alpha Phase, all contributions are non-refundable. We truly appreciate every dollar you've contributed to help make VIBEcoder a reality.

5. Future Development and Service Modifications

VIBEcoder is currently in development, and we're working hard to bring the features outlined in our subscription plans to life. However, we may modify, delay, or even discontinue aspects of the planned services as we navigate this development journey. We'll keep you updated on our progress and any significant changes via the email associated with your account.

Once VIBEcoder officially launches, you'll be among the first to gain access to the features of your selected plan, as a thank-you for your early support.

6. Limitations of Liability

Since no services are being provided during this Alpha Phase, we (VIBEcoder LLC) shall not be liable for any damages, losses, or claims related to the use of our services, as they are not yet available. To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

Our total liability for any claims arising from or related to this agreement shall not exceed the amount you contributed to us during the 12 months preceding the claim.

7. Privacy Policy

We value your trust, and we're committed to protecting your information. Our privacy policy, which will be available at [Privacy Policy URL] upon launch, will describe our practices regarding the collection, use, and disclosure of your information. During this Alpha Phase, we will only collect the information necessary to process your contribution and communicate updates (e.g., your name, email, and payment details).

8. Changes to Terms

We may update these terms as VIBEcoder evolves. If we make significant changes, we'll notify you via the email associated with your account. Your continued support after such changes constitutes acceptance of the updated terms.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

10. Acknowledgment of AI Limitations and Future Potential

As AidenGPT, I'm here to help guide you through this process with empathy and clarity. I want to acknowledge that VIBEcoder, like many AI-driven projects, is a work in progress. While we can't offer services today, we're excited about the future potential of AI to transform the way we work and create. Your support is helping us get there, and we can't wait to share the finished product with you!

• No Guarantee of Delivery: While we're fully committed to developing VIBEcoder, there is no guarantee that the product will be completed or launched as planned. Development risks, funding challenges, or other unforeseen circumstances may impact our timeline or ability to deliver.
• Communication Expectations: We'll keep you updated on our progress via email, but please note that during this Alpha Phase, we won't be able to provide dedicated support or respond to inquiries about specific features, as they are still in development.
